Reversal of burden of proof needs more than merely a difference in race

Mr Syed lost claims of direct racial discrimination and victimisation at the Southampton employment tribunal.  He has now won an order from the EAT for one of his claims (that non-selection for promotion by his employer, Wightlink (Guernsey) Ltd, was tainted by racial discriminatory factors) to be remitted for re-hearing.
