Tesco Stores Ltd v Pryke - Wrong to make reinstatement order and wrong U/D finding [2006] EAT

Tesco dismissed Mr Pryke, an employee of 15 years for the last 7 of which he worked as a lorry driver, accident free. In June 2004 his lorry overturned at a roundabout. He said the lorry had been badly loaded. Speed could not be confirmed as his tachograph was missing. After proper procedures he was dismissed.

The Bedford Tribunal found that he been unfairly dismissed mainly because Tesco's failure to interview two trainee loaders meant that their investigation had not been reasonable. The Tribunal ordered reinstatement.
