Toilet Breaks
Key points
- The Workplace (Health, Safety and Welfare) Regulations 1992 SI 1992/3004 require employers to provide "suitable and sufficient sanitary conveniences" at "readily accessible places". However there is no specific law which specifically gives employees the right to take time off work to go to the lavatory. Clearly this right is implied into any employment contract.
- There is a general statutory right to a 20-minute rest break if working time exceeds six hours ( under the Working Time Regs).
