Transport and General Workers Union v Brauer Coley Ltd - Protective award only for employees in respect of whom a TU was recognised  EAT
A "protective award" can be ordered by an Employment Tribunal in favour of individuals who have been made redundant if, in a collective redundancy situation, their employer fails to consult in advance. Different rules apply depending on whether a trade unon is or is not involved.
In this case the TGWU won a protective award in favour of employees in respect of whom it was the recognised trade union. The question then arose as to whether the award inured only for the benefit of those in respect of whom the TGWU was recognised as trade union or whether others could benefit.
