Mr Turner was dismissed and brought various employment tribunal claims. He was represented by his wife, a solicitor and part time tribunal Chairman. It became clear that they had withheld certain documents belonging to the Sandhams, his former employers. The documents contained information about cash payments which would be of interest to the Revenue authorities. It seems the Turners were effectively attempting to coerce the Sandhams into a settlement in order to avoid these matters coming to light at any hearing. An employment judge struck the claim out and Mr Turner appealed.
