Unegbu v Newman Stone Ltd - The simple withdrawal of a claim, without more, cannot amount to unreasonable conduct and thus cannot be the basis for a costs order [2008] EAT
Shortly after serving a Race Discrimination Act questionnaire, Mr Unegbu presented his ET1 claim to an employment tribunal on the day the time limit expired. Newman Stone filed a Response (ET3). The tribunal listed a case management discussion but shortly before that CMD, Mr Unegbu withdrew his claim - citing as his reasons the contents of the ET3 and ill-health following an assault.
