Advocate General’s Opinion that bonus cap is valid
The ECJ has issued a press release on the Advocate General’s Opinion (which has not yet been published) on the UK’s challenge in UK v European Parliament and Council of the EU to the validity of the bonus cap provisions in the Capital Requirements Directive 2013 and Regulation.
The Advocate General, which is not binding on the ECJ but is usually followed, dismissed the UK’s argument that the remuneration provisions were adopted on an incorrect legal basis.
