Vaidya v The General Medical Council - Harassment by qualifications bodies [2011] EAT

A claim of harassment by a Qualifications Body under Race Relations Act 1976 (or, now, Equality Act 2010) applies only in relation to acts of harassment done by that body in relation to an authorisation or qualification conferred by it.

Dr Vaidya has brought a number of employment tribunal complaints; this one was a complaint of, among things, racial harassment by the GMC. Dr Vaidya brought his claim under Race Relations Act 1976 sec 12(1A) which prohibits harassment by "Qualification Bodies" (of which the GMC is one).
