Van Dieren v Edwards and Van Dieren-Hulsman - Dismissal/disciplinary procedure or Grievance procedure [2006] EAT

A claimant was a day late in getting in his unfair dismissal claim. He asserted that time was automatically extended under the statutory procedure rules introduced in October 2004. The employment tribunal became confused as to whether it should be applying the dismissal/disciplinary or the grievance procedure rules and wrongly applied the latter.

The EAT has remitted the case back for reconsideration.
