Virdi v Commisioner of Police of the Metropolis & anor - Extension of time for making discrimination claims [2006] EAT

In a combined race and disability discrimination case the EAT has overruled an employment tribunal's refusal to allow an extension of time for submission of a claim when the failure to submit on time was the fault of the solicitors concerned.

The EAT ruled that the race discrimination claim which had been submitted just one day out of time should be allowed to proceed and that in relation to the disability discrimination claim which was three months out of time the question of whether an extension should be allowed should be remitted back to the tribunal for reconsideration.
