Virgin Media Ltd v (1) Seddington (2) Eland - tribunal should have considered Polkey deduction

Telecoms salesmen Mr Seddington and Mr Eland were dismissed as redundant. Virgin accepted that, due to errors on its part, the stautory dismissal procedures had not been followed and so the dismissals were automatically unfair. However the tribunal also concluded, looking at the substantive merits of the case, that Virgin's handling of the redundancy situation was flawed in a number of ways, and that it would therefore have found the dismissals unfair anyway.
