Vision Information Services (UK) Ltd v L C Coutinho - TUPE transferor's right to appeal judgement awarded against transferee [2007] EAT
Where ownership of a business is transerred and the TUPE regulations apply, liability for any related unfair dismissal automatically passes to the transferee. But if, as is common, under the terms of the deal the transferor has indemnified the transferee against that liability it is the transferor which ultimately bears the cost even though it has no liability to the dismissed employee. In such circumstances, when an employment tribunal has given judgment against the transferee, can the transferor appeal to the EAT? The answer appears to be yes.
