Wain & ors. v Guernsey Ship Management Ltd. - TUPE and "identifiable economic entity" [2006] EAT
Wightlink Ltd ran ferry services between England and the Isle of Wight. Some staff working were seconded from an associated company Wightlink (Guernsey) Ltd ("WGL") and others were hired from an unconnected company called Guernsey Ship Management Ltd ("GSM"). Mr Wain and five others, the six claimants in this case, were amongst the staff provided by WGL. When the fixed-term contracts expired in September 2004 the 6 men were taken on by GSM which went on supplying their services to Wightlink but paying them at a lower rate.
