Waller v Bromsgrove District Council - overriding objective does not alter strict application of time limits - EAT 23.5.07
Mrs Waller won an unfair dismissal claim but was dissatisfied with the compensation awarded and appealed to the EAT. Her appeal was lodged 9 days out of time. The Registrar refused to extend time.
Mrs Waller argued that application of time limits with "mechanistic venom" was inconsistent with the overriding objective in Employment Appeal Tribunal Rules 2003 r.2A which should alter the EAT's approach to time limits.
