Wareing v Stone Cladding International Ltd - Let-out from automatically unfair dismissal for not following proper procedures [2006] EAT
Mr Wareing lost his unfair dismissal claim against his former employer, Stone Cladding, even though they had not complied with the legally required statutory dismissal procedures. Stone Cladding established that it would have dismissed Mr Wareing anyway, even if it had complied with the statutory dismissal procedures and an employment tribunal held that therefore the dismissal was not "automatically unfair dismissal".
