Waters v Bankside Leisure Ltd - Prejudging outcome of disciplinary hearing is substantial not procedural [2006] EAT

An employee who was also a one third shareholder in, effectively, a 3 man company was dismissed by his two "partners" for dereliction of duty (he failed to reapply for a licence needed for the night club they ran). Having decided to dismiss him, the other two "partners" went through what were, in their view, the necessary hoops to ensure the dismissal was procedurally fair.
