Watson v Pinguin Foods Ltd - Continuous employment and TUPE [2006] EAT
An employer was placed in receivership and various employees, including Mrs Watson, who had about 25 years continuous service were dismissed as redundant. Not long afterwards the business was sold in a TUPE transfer.
The new owners later reemployed Mrs Watson but about two years later dismissed her. That dismissal was unfair. The Norwich employment tribunal calculated her basic award on the basis that she had 2 years service.
