West Coast Trains Ltd (t/a Virgin Trains) v Tombling EAT - When are there reasonable grounds to sustain genuine belief in misconduct? EAT
Mrs Tombling was a Customer Services Assistant. She broke the computerised till in the train shop. Her explanation was that she hit it with her head when the train suddenly lunged: West Coast Trains did not accept this, since on investigation CCTV evidence did not indicate any such sudden movement of the train. Concluding that she had willfully broken the computer, West Coast Trains dismissed Mrs Tombling.
