West Dunbartonshire Council v Smith & Others - equal pay claims and statutory grievances

In equal pay claims it was important that the complaint in the ET1 was essentially the same as the written grievance submitted under the Employment Act 2002. Where an ET1 claimed equal pay for a job of equal value, and the written grievance stated equal pay for a job rated as equivalent, the procedure would not have been complied with, since there would not be an opportunity for the employer to address the complaint.
