White & Anor v Troutbeck SA EAT
Correct question for employee status is not whether employer exercises day to day control but whether it retains sufficient right of control
Mr White and Ms Todd were engaged by Troutbeck as caretaker/manager of a house and small farm estate ('Starcross Farm'), responsible for undertaking duties which included what might be described as estate management together with maintenance of the house and grounds, including housekeeping. The owners of Starcross were Troutbeck and another Panamanian company owned by a Nigerian family, the Ibrus. The Ibrus were absentee landlords who rarely visited the property.
