Whitehead v Corley School & anor - Contributory fault calculation on unfair dismissal [2007] EAT
Mr Whitehead, an experienced special needs teacher, was sacked after a relatively minor incident invovling an unruly pupil. He was dismissed and claimed unfair dismissal. He won but the tribunal reduced compensation by 50% on grounds of contributory fault. On appeal, the EAT has remitted the issue of contribution to a fresh employment tribunal. The original tribunal had failed to consider as separate questions the issue of contributory fault and the issue of whether the dismissal was fair or unfair.
