Whitehouse v North Bristol NHS Trust - Deduction from wages [2006] EAT
There are standard terms for protecting the pay of hospital junior hospital doctors who agree to change to a new post which is later "rebanded" to a lower pay band. Each band has a scale and the question in this case concerned the date at which the appropriate reference point on the scale should be calculated - should it be the date of rebanding of the the new post (as the NHS Trust claimed) or the date on which the doctor takes up the new post (as Dr Whitehouse claimed)?
This was a test case as different Health Authorities had come to different answers.
