Although his contract provided that he should do so, Mr Bunn had (with Gilberts' agreement) routinely not worked on Mondays. When Gilberts then suddenly told him to do so he refused in no uncertain terms. He was suspended without pay (without being given a letter beforehand explaining why) and subsequently dismissed. Mr Bunn claimed that he should have been paid for the three weeks of his suspension.
