Winchester & Eastleigh Healthcare NHS Trust v Walker - NHS employees and continuity of employment for a Basic Award [2011] EAT

When calculating the Basic Award for an unfairly dismissed employee of an NHS Trust, their employment cannot be deemed continuous with any previous employment they may have had within the NHS with other bodies unless either TUPE, or the specific provisions of Employment Rights Act 1996 section 218, apply to their particular circumstances and employment history.
