Wolverhampton University v Elbeltagi - time limits and reasonable practicality - EAT 13.7.07
Wolverhampton University summarily dismissed Dr Elbeltagi for gross misconduct on 11 July 2006. Dr Elbeltagi appealed. At the same time, negotiations took place and it looked as if Dr Elbeltagi might instead be allowed to resign, effectively negating the dismissal. Things did not work out as hoped, however, and on 7 October a "shocked" Dr Elbeltagi was told that his appeal had failed and his dismissal stood. On 12 October he presented a claim for unfair dismissal to the employment tribunal - 2 days outside the three month time limit.
