Wright v Weed Control Ltd - A breach of an obligation of confidence (in respect of which an employment tribunal has no jurisdiction) is not the same as a breach of the implied term of trust and confidence [2008] EAT

Mr Wright, who had been dismissed as MD of Weed Control Ltd for various acts of misconduct, won a claim he made to an employment tribunal that Weed Control had made an unlawful deduction from his wages. At the tribunal Weed Control had won a counterclaim for £18,000 because through his misconduct the company had had to pay a fine of that amount. Mr Wright appealed to the EAT against the order that he pay compensation to Weed Control.
