Written Statement of Employment Particulars
- It is a legal requirement that employers provide their employees and workers with a written statement of employment particulars setting out specified minimum basic terms on or before day one of the start of their employment (s.1 Employment Rights Act 1996 (ERA 1996)).
- The written statement of employment particulars is only the bare minimum required however and in practice, a more detailed formal contract will be desirable in most cases, which can include those matters set out at s.1 ERA 1996.
- Significant changes were introduced in April 2020 by virtue of The Employment Rights (Employment Particulars and Paid Annual Leave )(Amendment) Regulations 2018 (SI 2018/1378). This needs to be read together with the Employment Rights Act 1996 pending its update at legislation.gov.uk
