Yellow Pages Sales Ltd v Davie - When exactly is a faxed ET1 form "presented" to the tribunal? [2011] EAT
An employment tribunal claim sent by fax is presented - in writing - at the date and time that the tribunal's fax machine confirms successful receipt of the faxed document. The fact that, due to some error, the claim is never subsequently printed out by the machine does not alter that fact. A similar approach applies to claims sent via electronic communications such as e-mail.
