Young v Hexion Speciality Chemicals UK Ltd - Employment commencement date is not "required information" for valid ET claim [2009] EAT

A tribunal should only reject a claim if it is sure that it does not have jurisdiction to entertain it; it need not be satisfied that it does have jurisdiction in order to accept it.

Mr Young presented a claim at the employment tribunal, alleging unfair dismissal by way of unfair selection for redundancy. His form ET1 stated that his employment terminated on 4 December 2008 but he failed to complete the box on the form stating when his employment started. .The Tribunal refused to accept the claim because, said the Employment Judge (EJ),  without this box being completed the tribunal could not know whether Mr Young had the necessary one year continuous employment to be able to claim unfair dismissal. As Mr Young had presented his ET1 on the last day before the three-month time limit ran out he was not able to start again to sort matters out.
