Yuan v Birkbeck College - How long was notice period [2006] EAT

The long running saga of Dr Yuan's wrongful dismissal claim against Birkbeck College (3 tribunal hearings and five appeals to the EAT) is almost at an end. The Tribunal failed to give adequate reasons to show why the notice period should be one month rather than three (the issue left to them by an EAT decision).
 

The EAT has awarded him three month's notice pay instead of one month's notice pay. The final amount is still to be agreed as there may be offsets (eg for failure to mitigate loss)
