Zepbrook Ltd v Magnus - Mitigation of loss during notice period [2006] EAT

This case confirms that the rule that a person who has been dismissed without notice should not be required to offset against compensation any wages he earns during what would have been the notice period applies in unfair dismissal cases only. It does NOT apply in wrongful dismissal cases (in which the normal common law rule applies to the effect that a claimant is under a duty to mitigate his loss).
