Zeynalov v BP Exploration (Caspian Sea) Ltd & Others - Oral hearing to consider strike out must be held if party requests it [2008] EAT
Mr Zeylanov brought a complaint of unfair dismissal, which was struck out. He instituted new claims, which an employment judge concluded effectively repeated the original one. Before striking them out (as she was minded to do) she advised the parties of her initial view and invited written submissions. Both parties provided these. Mr Zeynalov also sought an oral hearing. The employment judge refused this and, solely on the correspondence, submissions and papers struck out his new claims. Mr Zeynalov appealed.
