Zimmer Ltd v Brezan EAT - statutory procedures and automatically unfair dismissal
Mr Brezan was employed by Zimmer Ltd of Swindon as Regional Sales Manager for much of the South of England.
The company became concerned that he was wrongly claiming mileage allowances. It sent him an e-mail inviting him to a disciplinary meeting. This identified 'mileage and expense claims' as the item for discussion. It did not indicate that dismissal was a possible outcome, it wrongly identified the Claimant's right of accompaniment and it allowed less than 48 hours before the meeting.
