Zulhayir v JJ Food Service Ltd - Failure by absent employee to notify employer of address change did not, in itself, terminate contract [2011] EAT

Repudiatory conduct by an employee cannot terminate an employment contract in itself without more: the employer must accept the repudiatory breach and notify the employee that he has done so (whereby it is then the employer who actually ends the contract). Old authorities from the 1970's that suggest otherwise are no longer good law and should not be followed.
