Pola v The Crown (HSE), [2009] EWCA Crim 655 - a casual worker can be an employee for Health & Safety purposes

Mr Shah Pola, a "cunning" construction site boss who showed a "callous disregard" for safety that led to a near-fatal accident was jailed for six months and ordered to pay £90,000 compensation (under the Powers of Criminal Courts (Sentencing) Act 2000 s.130) to a severely injured worker in September 2007. He has lost an appeal which was largely based on whether the injured worker was an "employee" within the meaning of the Health and Safety at Work Act 1974 s.53.
