Ministry of Defence v Radclyffe - an army officer who is off duty nevertheless owes a duty of care to his subordinates

The High Court held that held that the Ministry of Defence was vicariously liable for the negligence of an officer which resulted in a more junior officer suffering injury when he jumped 65 feet from a road bridge into a reservoir in Germany in August 2003 (although the Court also held that the injured officer had been 40% responsible for his injury).


The Ministry of Defence has now lost an appeal to the Court of Appeal.
