The serious nature of a disqualification order under the Company Directors Disqualification Act 1986 means that, where there is no dishonesty, the burden in establishing unfitness based on incompetence is a heavy one.  In this case the wrong balance had been struck between marketing considerations and the interests of the consumer and disqualification orders were made.
