Meerts v Proost NV ECJ Case C-116/08, Parental Leave and dismissal

In this Belgian case the European Court of Justice has been asked to consider whether a person dismissed without notice while on part-time parental leave is entitled to compensation for pay in lieu of notice based on full normal salary or whether it should be based on the reduced salary they had been receiving while working part time.

An advocate-general has now recommended that the ECJ should rule that, in those circumstances, pay in lieu of notice should be based on full salary
