Chartbrook Ltd v Persimmon Homes Ltd - pre-contractual negotiations and rectification of contracts

a case in which the House of Lords considered the extent to which context and backgound can be taken into account in determining the proper meaning of words in a contract.  Overruling a majority decision by the Court of Appeal, the House of Lords took into account the commercial background behind the contract in interpreting a badly drafted, even nonsensical, part of it.
