Launahurst Ltd v Larner - no basis for tribunal's conclusion that contract was a "sham"

Given that the point had not been raised before it, and accordingly was never fully argued with evidence, an employment tribunal had no basis for concluding that a contract, which purported to exclude an employment relationship, was a "sham".
