Vatsouras & Anor v Arbeitsgemeinschaft (ARGE) Nürnberg 900 - entitlement to benefit can be made dependent on establishing link with labour market

The ARGE is, essentially, Germany's "job centre". Mr Vatsouras and Mr Koupatantze (both Greek nationals) had both been receiving basic benefits for job seekers. These were then withdrawn under German law: excluded from benefits for job seekers are foreign nationals whose right of residence arises solely out of the search for employment, and foreign nationals who have entered the country in order to obtain social assistance or whose right of residence arises solely out of the search for employment. Benefits are paid, however, to those with temporary residence rights.
