Elizabeth Emanuel v Continental Shelf 128 Ltd - use of name in trade mark - ECJ Case C-259/04 on 19.1.06

ECJ Advocate-General recommends the Court to rule that Elizabeth Emanuel, the designer of Princess Diana's wedding dress, does not have an overriding right to prevent use of her name by a company with which she has no connection in a graphic trade mark which she sold off as a trademark.
