Spencer-Franks v Kellogg Brown & Root Ltd & Ors - PUWER regulations - Scottish Court of Session 29.3.07

This case confirms that the Provision and Use of Work Equipment Regulations do not cover injuries arising from a defect in any equipment in the workplace. In this case, a worker was repairing a door closer and was injured by it. The Court has held that it was not "work equipment" within the meaning of the PUWR regulation - his screwdriver but not the faulty door closer on which he was working was "work equipment".
