Gover v PropertyCare Ltd - review of ET or EAT - Court of Appeal 28.3.06

The Court of Appeal dismissed this appeal. In doing so it called into question the long established view that the job of the Court of Appeal is to review the original tribunal's decision rather than that of the EAT (para 8). The Court of Appeal also confirmed that an appeal court will generally not interfere with a decision by an employment tribunal on the question of whether compensation should be reduced if a dismissal is unfair because of an unfair procedure but would have taken place anyway if a fair procedure had been followed.
