Lonsdale v Howard & Hallam Ltd - basis of compensation, appeared on Bailii 08.02.2006

The Court of Appeal has overturned previous rulings (notably from Scotland, historically closer to France than England) that in the case of breach of at least some UK regulations which implement EC directives it can be appropriate to drop common law methods of assessing compensation (ie by reference to loss suffered) and instead adopt a continental "formula" method (for further notes see at European Law / priority over English law).
