Dhesa v Glasgow City Council - race discrimination, Court of Session, appeared on Bailii 24.02.2006
An employment tribunal decided that Glasgow Council had racially discriminated in favour of a Scot and against an Indian as job applicants. The EAT overturned this. The Court of Session has now restored the original tribunal decision. Under the new "burden of proof" rules introduced in 1993, once a difference in treatment of persons of different race was shown, it was up to the Council to prove that that difference was not by reason of race - which the Council had failed to do.
