Hill v Clacton Family Trust Limited, Court of Appeal on 17/10/05

Two different tribunals came to different decisions on whether Ms Hill was suffering from a disability (post traumatic stress disorder after witnessing a horrific accident some months previously) at the time of her dismissal. The Court of Appeal has now ruled ([2005] EWCA Civ 1456 on 17/10/05) that she was not suffering from a disability within the meaning of DDA 1995 s.1 at the date of her dismissal.
