Annandale v. Santa Fe International Services Inc - 'special cause' for non-jury trial - Court of Session (Scotland), 29.3.06

Mr Annandale, an oil rig worker, is claiming £1m damages after receiving serious head injuries at work. The employer argued that there is ‘special cause’ to make the case unsuitable for a jury trial, referring to the complexity of the injuries and medical issues arising therefrom and the consequent financial claim. The Court of Session dismissed the employer's arguments and held that the action was suitable for trial by jury.
