George McEwan v Lothian Buses PLC (Scottish) - personal injury, Court of Session 4.4.2006

Mr McEwan sustained injury in the course of his employment when he slipped on spilled fluid spilt. The court found that there was not adequate drainage to prevent the accident. However contrary to Mr McEwan's evidence it also found that it was he who had spilled the fluid. Although Lothian Buses were in breach of regulation 5(1) or 13(1) Workplace (Health, Safety and Welfare) Regulations 1992, contributory negligence was assessed at 75% and Mr McEwan was awarded only £1,125 plus interest from 17th March 2006 until payment.
