Secretary of State for Trade and Industry v Rutherford & Anor. - HL 3.5.06

The House of Lords has unanimously dismissed an appeal by Mr Rutherford. The provisions of British law under which an employee aged 65 or more at date of dismissal cannot (normally) claim unfair dismissal or statutory redundancy pay are compatible with EC anti-sex discrimination rules and are enforceable - but anyway will be removed on 1st October 2006 when the Employment Equality (Age) Regulations 2006, SI 2006/1031 come into force.
